Job Issues Part 2: Thoughts needed!
Ok so last week I posted this:
Work Issues. Am I justified or over reacting? HELP!!
And today I have a job offer. $1 per hour pay cut, call center enviornment (I am comfortable in a call center) and benefits after 3 months. (Slightly uncomfortable with that but there is always COBRA)
QUESTION:
Considering the above mentioned issue it is OK to not give 2 weeks notice, right? That's a professional courtesy and not the employer's "God Given Right" correct?
I need thoughts on HOW to resign on such short notice. I have never done it before and I feel *Really guilty* although I shouldn't because of the way that he has treated me.
Why, why, why do I feel guilty?

You feel guilty because your a sweet person and want to treat others the way you want to be treated. That's not a bad thing!
As far as I know, there is no "law" stating you must give two weeks notice. Typically, this is a policy by HR, and can be found in any employee handbook (if they have one).
After the way you've been treated, I would give my notice that morning, wait for my check, then leave. As for California law, if someone calls your old boss for a reference, he can only verify you did in fact work there. Anything more (especially if it's negative) will get his butt in a wringer.
By the way, there are businesses out there who specialize in calling your former employers (as if they are checking you for a job) for a reference to see what they say, and will report back to you exactly what they say. This way, you can know exactly what to expect.

At will
California for the most part is an "at will" employement. What that means is you can at anytime quit, or they can at any time fire you without notice. This is how I would look at it from your stand point. 1) he's RUDE! 2) he made promises he didn't keep & 3) you arleady told him at one point you were going to look for a new job. Do you think he would give you a notice if he was going to let you go???  I'm gonna go with no! So go in today and tell him that Friday will be your last day. Stay strong and DON'T let him bully you into staying. You can also continue on with Cobra for just yourself if you need to. Also if you lose bene's at your job it's a qualifying even change so if your husbands company offers insurance you can go on his until you are able to sign up for yours. Hmmm can you tell I do payroll, benefits & some HR.

Oh yeah and if you give more than a 72 hour notice they have to have your check in hand when you leave. If you don't get your check you can go to the labor board and they will have to pay you for 8 hours a day for everyday that it was late. This is true also if you are fired. If you give less than 72 hour notice then they have 72 hours to prepare your check.

I think since you told him awhile ago (not sure exactly how long ago) then, the whole 2 week thing is kind of a moot point by now. You've given him notice, whether or not he chose to act on it is not your fault.
You feel guilty because you're a kind and caring person and even though he is a complete ass hat, you don't want to "put anyone out" so to speak.

Awesome. Thanks you two. I think Baron hit it on the head. I always try to treat others better than I expect to be treated.
Jeanie, unfortch I carry the benefits since Dave is 1099. So its going to be scary but I will make it work.
I am waiting until Monday the 15th otherwise he will take all my payroll for the back benefits that I supposedly owe for my husband. Hes already taking $265 out of each check until its caught up. I feel like I am working for free because my checks are practically non existant because of the bene pay back.
So if I give notice after I cash my Monday payroll then I get to keep an extra $142.00. I think I deserve that.
Thanks Jenny. He did ask me in a round about way last Friday if I was leaving. He said "so about what we had talked about last week..." All I said was, "I dont ever want to be treated like that again. It is unprofessional and counterproductive to treat an employee like that regardless of the mistake that was made."
He defended it. The other girl in the office defended it. They both basically said he only yells when trying to make a point. I pointed out it was still unacceptable, and they again responded "But you got the point?"
Yeah. And now I am making mine.
And look Alleusion, with a 5:45AM start time I can make my guild raids again! Granted I am 4 expansions behind and have zero DKP but what the heck! LOL!

I would wait also until you get your money. The guy is a jerk and he doesn't deserve you. Kick him where it hurts.......in the pocket book!

Yeah as soon as I find whatever box my power cord and ethernet cable crawled up into, Andrew is going to reformat my harddrive and I can use that computer to EQ again. I spent this past weekend with my game friends at a cabin near a lake in northern Ontario. We had so much fun and it was so great to be around them again, I want to log in and bug them, but can't.

Seven more weeks until we find out if it's a boy or a girl! It's so neat right now cause I can feel the flutters. I guess some people do, and others don't feel movement this early. Lemme tell yah, this one is active. Especially when I am hungry = )
Jenny, it's amazing how the EQ bug still bites lol. I am going to love my maternity leave. /Grin.
Have you had a chance to go to the doc yet?

Oh Tammy honey  Your first post gave me a chuckle since I got my fathers so ruffled before. Pat and Jeanie have it absolutely right (thanks guys!) with your rights and CA law. I would simply walk in the morning of the 15th close his office door, and tell him your last day. I'll betcha he'll grovel...and DO NOT succumb to him and his abusive ways. I am so proud of you for calling him on his behavior, and following through with this. Re-read Jeanies post so you know your rights and he doesn't try to pull any funny stuff on you....
