car financing
Does anyone know someone who works for a car financing company? Have a couple of questions regarding having a loan and getting into a car accident and the other person didn't have insurance.

I can't help you but I just wanted to say that it sucks that you are in this situation. I live in a no fault state and getting into an accident with someone who isn't insured is my biggest fear.

Does CA have an uninsured motorist fund? I live in MD and...grrrr...part of what we pay in car insurance goes into a big, statewide fund to cover accidents that are caused by uninsured drivers. It sucks to have to pay for some slacker who won't get insurance but at least there's coverage if they also forget how to drive and hit you!

No CA does not have that. It was something you have the choice to buy, which I thought I did. I changed insurances and I guess they didn't ask me that question and I didn't bother to ask because I just assumed that was normal. Now I am finding out after the fact. I just don't know if I should call the co I finance my truck through and let them know what happened or what. I still owe alot of money on the truck and can't afford to pay $400 a month for something that I can not even drive. I was hoping someone worked for a finance company and new what the process is for something like that.

Don't give up, yet, about someone with real industry knowledge chiming in, though. Sometimes people are slow getting to all of the posts but, inevitably, somebody knows something and will pipe up eventually.

Same thing
happened to me when I was 18 yrs old. I lived in another state similar to CA law. My father ended up paying for the damages to my vehicle, and the uninsured motorist got slapped with court docs by my father. He lost in court of course and filed BK and that was the end to my claim he never paid a dime of it! It's kind of live and learn... unfortuantely.
Your only recourse with this driver is to take them to small claims for 5K max you can file, or superior court for more than 5K. You can represent yourself in either court, and it's a pain in the butt! I would try and get the uninsured driver to pay for the damages, or threaten you will have them arrested and tell them you are taking them to court for it. LOL Hey make them squirm because you are! 1) Are you insured through an agency, a brokerage or a direct handling company?
2) Invoke the privacy act and advise the company that wrote your policy that you want to see all documents pertaining to the policy. Specifically, you want to see the original application that has your *SIGNATURE* declaring that you DECLINE uninsured motorist coverage. If you didn't sign, you didn't decline REGARDLESS of what they verbally tell you.
3) if the vehicle is financed I assume you have collision coverage? You should have the collision deductible waiver which in essence waives the deductible because the person is uninsured. Your company should pay the loss and pursue the other party for recovery. Then again, you have to have Uninsured motorist bodily injury in order to have UIM Collision deductible waiver so I just answered my own question. (The collision ded waiver is a CA thing for you outta state peeps) .
4) If you do not have the collision deductible waiver you pay the $500 deductible (or what ever it was) and get the vehicle fixed. Worst case scenario you are out your deductible. They cannot deny you the right to have your vehicle fixed if you have collision.
5) If you didn't have collision coverage you are probably in breach of contract for the loan and will probably have to eat the amount of the loan.
6) You have the option to sue the other driver in court for damages.
