you are correct, I misspoke. You should be able to use FMLA after you've exhausted all other sick time etc.

the kicker will be the # of employees in her company...

I was in the same boat this week. I scheduled surgery on Wednesday and sent out a note later that day that I would be gone. The admin assistant (who thinks she is my supervisor and runs the office) called me in and said that I'd need to postpone my surgery or get a note from my doctor saying it is medically necessary now. I called my doc, almost in tears (I've been waiting for this for 2 years!!!), and they faxed me a letter. It was a dang good one too. If you read it, you'd think I would die next week without the surgery. So call yoru surgeon's office and see what they can do for you. I'm sure they run into this kind of thing all the time.

It is so interesting how a year goes by and things change.

Well during May last year I ended up in the hospital. And ended up using 10 of my 12 weeks of FMLA. Because of my hips. I have to have both hips replaced. And during those 10 weeks i was in bed not able to walk. Still haven't had the hip replacements because i needed to lose 100lbs. Even though now i feel great and with the weight coming off its helping them so much.

So anyway.. What happened was I took those last 2 weeks I had of FMLA and went on with the WLS. By my second week I was ready to go back to work. And then that Saturday I started to throw up a lot and decided with the nurse I should do my full 6 weeks off. That ment I had to go on COBRA since my FMLA ran out. Well During this time my work and I were up to date with each other and everything was fine. Then ONE week before I was ready to come back. They laid me off AND ONLY ME. Telling me that my job was evaluated by the company. And they felt it wasn't needed. BULLSH*T! I know its because of me being out last year on medical and then this ending up taking me out a month longer then planned. Anyway.. So now here I am home on Unemployment now.

wow that is bullsh*t. I have to go on disabilty for my job and it does go under FMLA but a lot of people have done the surgery at my job. There are also a lot of employees here.

Other than that - how's it giong after surgery? I'm still pre-op. I have 2 more appointments with my PCP dr for the 6 months of insurance requirement. Hopefully I will go in late june/early july.

Things are going good. I had a lot of problems with smells causing me to throw up. I am hit and miss right now with it. But its calmed down A LOT! My Doctor said some people get it worse then others. Its just what comes with the surgery. Honestly, its not bad. Its like dry heaves.

I can honestly say the worst part of the surgery was the gas pains the first 2 days. It was right in my shoulder and I can take a lot of pain. But wow lol As soon as they gave me the pain meds it broke it up right away though.
