Thank you all for the information. I was told by HR I could not go on Short term because I was not married and did not have children. Even if I could it doesn't start until 2 weeks after im out of work. And Im really hoping to be ok to go back to work by then. I sit in my chair 90% of the day at work, Office Job.
I'm in a company of maybe tops 40ppl.

I have a sit down office job and took two weeks off for my lap rny. Honestly I could have came back to work the second week. Please do all of your research and don't let them bully you into not getting this surgery done. Good luck and keep posting.

THIS is encouraging! I am a secretary, and although I know we're all different, I'm hoping to only be out of works for two weeks tops as I have a week's vacation scheduled the month after. I would *love* if I could somehow make it back to work the second week....

Hmmm, short-term disability has nothing to do with being married or having children, so this statement made by your HR dept doesn't really add up. In fact short-term disability is something you apply for directly with the insurance company. Your company really does not approve or disapprove this.
However, the bad news here is that companies with less than 50 employee are not considered an employer that has to follow DOL's FMLA laws. The reason for this is that the DOL sees it as being too cumbersome for a smaller business.
Sorry to not have more positive news to share with you. Is there any possibility that you can work from home? That is what I did. I took 4 working days off as PTO and then worked from home for 6 working days.

Sorry, but I must disagree with this statement. Maybe this varies state by state, but I also live and work in Pennsylvania (same as the original poster) and from my own personal experience an absence turns into Short Term Disability on the 8th calendar day (not work day, but calendar day).

I suggest a careful review of the FMLA and then print the material and have a meeting with your supervisor. Be well-armed for the discussion, know your rights and be direct. I don't know if having kids or anything else is a requirement, but the internet has all the information. I hope you can have a productive meeting, and you'll probably educate the manager about the truth of FMLA!  Good luck, you'll find a solution!

I have 80 hours of vacation ... so I took 40 ... ;and then if I dont feel ok I can work from home for the other week... but I am pretty resilient... I hade a open hyterectomey and was back at work in 10 days.... sit down jobs rock...
Do you have sick time ?? I would just build up as much time as possible then they can tell you you cant take off.

I apologize if I mis-spoke and I am going to correct my post. I just researched and it looks like with the exception of 5 states (Pennsylvania is not one them) STD is determined by the carrier.
