It is sad that with everything out there to help protect employees there are still ways for employers to use this type of thing against the employee. It is one thing to ask questions about potential conflicts with work, past history, etc but I think bring up possible medical issues during the hiring process is crossing the line. Sad thing is though, regardless of the reason, companies tend to find a way to find a "ligitimate" reason for not hiring someone that they may not want to for potential issues later.
From the point I started seriously considering surgery I cut back on looking for a new job. As much as I hate the one I have, the insurance helps me grin and bare it, not to mention I have been there almost 2 yrs so at least I know under FMLA they have no ligitimate reason for them to deny me the time off. But still, I have not told anyone at work that I am considering this, or that it may be in my near future. I have seen too many people who have been doing the right thing leave the company for what was said to be a "fatal" error.
