That is total BS .. I don't know what the laws in Ohio are ... but in NY you can not be fired for having medical issues .... They can replace your job with someone who is there and able to do it ... but they must have a job for you when you get back.

It's one of the major labor laws here.

I'm sorry you are going through this

It's just not right ((((hugs)))))

Thought I would post a reply since I was also fired a couple weeks ago for the exact same thing. Under FMLA, you must of been employed at your place of employment for 1 year before qualifying for up to 3 months of unpaid time off, with a promise that you will have a job when you come back. Unfortunately for me, I was employed for 9 months when my complications started and since I violated my employer's attendance policy by being gone above my allotted 3 days, per 3 months, I was fired. There isn't much you can do in this case, since you are not protected under any laws since I did not qualify for FMLA and am not under a union..

I'm assuming something similiar to this applies to you.. and I'm sorry we are both having to go through this. But I stand firm next to the idea that everything happens for a reason. Take a breath, and take it a day at a time.

I didn't qualify for fmla because I hadn't worked enough hours in the preceding 12 months. The reason for THAT was that I was out on FCLA to care for my daughter so I couldn't accrue enough time. Each time I called in sick they put me on a step. Finally they fired me.

Yes, I was in the CWA union and supposedly they did everything they could to fight it, but Verizon's stance was that I violated the absence policy and the reason didnt' matter. The union could do nothing. I WISH they offered me a package! I am really shocked that the union couldn't have done more for me.

I get unemployment, but that won't last forever. So, I keep looking. Not much else I can do. Thank you all for your good wishes!!!

I work for T-Mobile as a customer service rep. I had WLS after working for them for 10 months. They have been very supportive, no issues at all. They gave me short term disability.. 60% of my wages.. for the time that I was out, an up down desk for when I got back (a desk with a movable desk top, so you can stand and take calls), and approached me about extra breaks for the first few weeks. Couldn't ask for anything more.

I have heard that the other cell companies are laying off. T-Mobile is still hiring. Good wages, great benefits. Yeah, the job is being a phone jockey.. talking to some of the most unpleasant of people is part of it. But, it isn't so bad. Most of the customers are nice, and if they aren't nice, at least reasonable. I like my bosses, I like my coworkers, and I like my schedule. Sometime soon, I will start looking at jobs within the company and work toward promotion.

You might want to check and see if they have any openings in your area. Just as a warning, be up front and honest about every job you have ever held, and report even your traffic tickets. They do a serious background check. https://tmobile.recruitmax.com/ENG/C...s/default.cfm?

Sorry to hear you lost your job. I work for Verizon as well...I started off in customer service also. It's a stressful job, but it does pay great. According to the attendance policy for an employee with less than 5 years service, you should have been progressed to Step 4 before being fired. You (and the union) should check and make sure the proceeding Steps 1, 2, and 3 were followed correctly. Absences that fell under FMLA do not count, but you must have worked so many hours (1250?) in the prior rolling year to qualify for FMLA.

Not sure if your policy in New Hampshire is exactly the same, but here is a link to the Mid-Atlantic Regional Attendance Plan: http://www.cwalocal2204.org/Document...rap_2_2007.pdf

If you haven't already done so, I'd recommend reading over that, and make sure the Steps were done correctly.

no, its true. Last year when the union threatened to go on strike, I got to go out and spend 2 weeks learning to climb telephones, and running and installing telephone lines. It was fun, and I didnt learn a lot.
